Terms of Service

Welcome to Tablos. These Terms of Service ("Terms") govern your access to and use of the Tablos mobile application, website at tablos.app, and all related services (collectively, the "Service"), operated by Tablos ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the Service.

2. Account Registration

To access certain features of the Service, you may be required to create an account. When you do, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your login credentials secure and not share them with others
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Using the Service

Tablos provides a QR-based ordering platform that allows you to browse menus, place orders, and make payments at participating restaurants, lounges, bars, clubs, and rooftops. When using the Service, you agree to:

• Use the Service only for lawful purposes
• Not interfere with or disrupt the Service or its infrastructure
• Not attempt to gain unauthorized access to any part of the Service
• Not use the Service to transmit harmful, offensive, or illegal content
• Not use automated tools (bots, scrapers) to access the Service without our prior written consent

4. Orders and Payments

4.1 Placing Orders

When you place an order through the Service, you are making an offer to purchase items from the participating venue. The venue reserves the right to accept or reject your order for any reason, including item unavailability, pricing errors, or suspected fraud.

4.2 Pricing and Availability

All menu items, prices, and availability are set by the participating venues and may change without notice. While we strive to display accurate information, we do not guarantee that all details shown on the Service are error-free.

4.3 Payments

Payments are processed through secure third-party payment providers. By placing an order, you authorize us to charge the applicable amount to your selected payment method. You are responsible for all charges incurred under your account, including applicable taxes, tips, and service fees.

4.4 Refunds and Cancellations

Refund and cancellation policies are determined by each participating venue. If you have an issue with an order, please contact the venue directly or reach out to us at hello@tablos.app and we will do our best to assist you.

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, software, and the overall design — are owned by or licensed to Tablos and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code of the software, unless applicable law permits it or you have our written permission.

6. User Content

You may have the ability to submit reviews, ratings, or other content ("User Content") through the Service. By submitting User Content, you:

• Grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your User Content in connection with the Service
• Represent that your User Content does not violate any third-party rights or applicable laws
• Acknowledge that we may remove User Content that violates these Terms at our discretion

7. Restaurant Partners

Tablos acts as a technology platform connecting you with participating venues. We are not the seller of any food, beverages, or services offered by venues through the Service. Each venue is independently responsible for:

• The quality, safety, and preparation of their products
• Accurate menu descriptions and allergen information
• Compliance with applicable health and food safety regulations
• Their own refund and cancellation policies

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy or completeness of any information provided through the Service, including menu items, prices, and venue details.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Tablos and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Tablos and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may also delete your account at any time by contacting us at hello@tablos.app. Sections of these Terms that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitations of liability, and indemnification.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with applicable arbitration rules.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
